Terms of service

These terms and conditions shall apply to all orders for goods received by Chewsy. No other conditions whether or not inconsistent with these conditions shall apply. It is very important that you read and understand them. These conditions do not affect your statutory rights. These terms and conditions are subject to change without notice and supersede all previous editions. We will be most happy to answer any queries you may have at sunitt@chewsygum.com

Acceptance of Orders
All orders are accepted by Chewsy subject to these conditions of sale. No variation of these conditions will be accepted unless previously agreed in writing by the Managing Director of Sweetastic Ltd. Orders will only be binding upon receipt of written confirmation from Sweetastic Ltd, who reserves the right to refuse any order. In the event of any pricing error occurring within this website, within any fax or e-mail correspondence however received, all incomplete orders shall be deemed void.

Customer’s Authority
Customers entering into transactions with Chewsy expressly warrant that they are authorised to accept and are accepting these conditions not only for themselves but also as agents for and on behalf of all other persons who are, or may become, interested in Chewsy’s goods or products, whether in whole or part.

Payment
We accept online payment through Shopify and PayPal. We do not store credit card details nor do we share customer details with any 3rd parties. If you are shopping from outside the Euro zone, place your order and your credit card company or bank will convert the transaction to your own currency. Payments can be accepted in Sterling Pounds. All orders for goods are subject to stock availability. If we do not supply goods to you for any reason, we will inform you of the situation and will refund any money already paid by you for these goods. We are not liable for any financial loss incurred by you relating to interest payments, or loss of earnings, or similar gains you would have received on monies paid to us in lieu of an un-fulfilled order.

Subscription
By clicking "Place my order", you confirm that your subscription will automatically renew and your credit card will automatically be charged the subscription price according to the "Order summary" section of this page until you cancel your subscription. You can cancel your subscription at any time.

Prices
All prices quoted or displayed are in GB Pounds at the time your order is placed. We are entitled to make adjustments to the price to take account of any increase in, or the imposition of new taxes or duties. If due to an error or omission the price published for the goods on our website is wrong, we have the right to terminate an order provided the goods have not been dispatched. We will try to ensure that all prices displayed on our website are accurate, but should an error occur, we would inform you of the correct price and give you an opportunity to cancel the order. Please note that the prices quoted are subject to availability and Chewsy reserves the rights to refund the payments to you if the database processes your order in error. Every effort will be made to maintain a stable supply and pricing policy subject to market conditions and variations. Chewsy reserves the right to alter prices without notice explanation or notification.

Care has been taken to convey the exact details and specifications of the products. Chewsy reserves the right to alter details and specifications without notice explanation or notification. Some photographs / graphics on the website are for graphical purposes only and may not be of Chewsy foods itself.

Retention of Title
All goods supplied by Chewsy to the customer shall remain the property of Chewsy until such time as Chewsy receives payment in full for the goods and of all other monies due to Chewsy from the customer. Until such payment as aforesaid is received, the separate identity of those goods shall be maintained by the customer. After delivery of the goods to the customer or his nominated sub-purchaser, the goods shall be at the customer’s risk and the customer shall insure those goods against loss or damage.

Until such time as title in the goods shall pass to the customer in accordance with the foregoing provisions, Chewsy shall be entitled at any time to repossess the goods whether with or without notice and Chewsy and its employees or agents shall have the right at any time to enter upon the premises of the customer for the purpose of effecting such repossession.

Force Majeure
Chewsy will not be liable to you for any failure or delay in performance of our contract, if it is due to an event beyond our reasonable control including, without limitation, acts of God, war, industrial dispute, fire, flood, tempest and national emergencies and if so delayed we shall be entitled to a reasonable extension of time for performing such obligations.
